Knowledge Auckland Information Community Terms of Use
Knowledge Auckland is hosted by the Auckland Regional Council (“ARC”). These terms and conditions (“Terms”) are between you and the ARC (referred to as "we", "our" or "us" in these Terms).
You are considered to have accepted these terms if you proceed to access the Knowledge Auckland Information Community. If you do not accept these Terms you are not permitted to use the Knowledge Auckland Information Community.
Use of the Knowledge Auckland Information Community
You have the right to access and use the Knowledge Auckland Information Community for lawful, personal and non-commercial purposes, in the manner permitted by Knowledge Auckland, and in compliance with these Terms (and any further terms, notices and limitations displayed by us on Knowledge Auckland from time to time).
Posting content…
We do not own any of the content that you may transmit or post to or through the Knowledge Auckland Information Community. This means that you alone (and not us) are ethically and legally responsible for this content and any consequences of its use.
Before accessing and using the Knowledge Auckland Information Community you agree that you:
• have first obtained all the necessary rights and permissions from the owners or licensors of this content;
• grant to us and our service providers a non-exclusive and royalty free right to use, modify, adapt, reproduce, publish and distribute this content for the purpose of providing and supporting Knowledge Auckland; and
• grant other members of the Knowledge Auckland Information Community the right to access, download and view this content for their lawful, personal and non-commercial purposes.
Use other people's materials with care…
You may access, download and view content posted by other users for your lawful, personal and non-commercial purposes. However, if you want to do anything else with this content you must first obtain the necessary rights and permissions from the relevant owners or licensors. You must also comply with any licence Terms that those owners or licensors may specify for those materials.
Respect others…
When accessing and using the Knowledge Auckland Information Community you agree to do so in a reasonable and proper manner that complies with all laws or regulations and does not infringe the rights of us or anyone else. You are responsible for honouring the rights of others, and for treating others who use the site with respect.
You agree not to post or transmit material that is offensive, discriminatory or illegal, or which otherwise causes annoyance or inconvenience.
Knowledge Auckland is your space, and we don't screen material before it is posted on the site. In order to ensure that the site is running well, and that the Knowledge Auckland Terms and the Knowledge Auckland Information Community Terms are upheld, from time to time it may be necessary for us to monitor site activity.
We reserve the right, in our absolute discretion, to:
• remove or edit any material that is offensive, discriminatory, or illegal, and/or exposes Knowledge Auckland, us or its users to any risk, or is otherwise unacceptable to us; or
• remove or suspend the accounts of users.
You must comply with all our instructions and restrictions regarding the use of the Knowledge Auckland Information Community.
Keep it commercial free…
Knowledge Auckland is a community site, not a commercial site. When you use the space you agree not to post commercial ads; send unsolicited emails; collect email addresses for commercial use outside the site; or use the site for any other commercial purposes.
We will try to keep you safe, but you're responsible too…
While we try to make Knowledge Auckland Information Community secure we do not promise that it is completely secure or that the materials you post or transmit will never be lost or damaged. It's up to you to make sure that you can recover or replace any of your materials that are lost or damaged for any reason.
You are responsible for ensuring that your password is kept confidential. You must also provide us with registration and other required information that is current and accurate.
We look after your personal information…
Please see our Privacy Statement for how we collect and use your personal information and your rights in relation to that information. By accepting these Terms you also accept our Privacy statement.
We may send occasional technical messages by email…
You agree that we may from time to time send you emails that relate to the Knowledge Auckland Information Community (for example, emails explaining any important technical or practical issues affecting the operation of the site).
The Knowledge Auckland Terms of Use also apply
By accepting these Terms you also accept the general terms of use outlined in the Knowledge Auckland Terms of Use.
These Terms may be updated…
As circumstances change we may decide to change these Terms. We will take reasonable steps to give you notice before any changes take effect (and we will do this by posting a notice in Knowledge Auckland). Any use by you of the Knowledge Auckland Information Community after the new version of these Terms has been posted in Knowledge Auckland confirms that you accept the changes. Any other changes to these Terms must be in writing and signed by one of our authorised representatives.
General stuff…
Any and each waiver of any of these Terms must be in writing and signed by one of our authorised representatives. A delay or failure by us to exercise any right does not prevent us from exercising that right, or any other right, on that or any other occasion.
If any one or more of these Terms is deemed to be invalid, illegal or unenforceable, the remaining provisions will remain in full force and effect.
In these Terms, words in the singular include the plural and vice versa; any examples in these Terms, and references to "including" and similar words, are illustrative only and do not imply any limitations; and any headings are for ease of reading only and do not affect the interpretation of these Terms.
These Terms, the Knowledge Auckland Terms of Use and the Privacy Statement form the entire agreement between us and you relating to Knowledge Auckland and your use of Knowledge Auckland.
These Terms are governed by the laws of New Zealand and you submit to the exclusive jurisdiction of the New Zealand courts.
